Terms of Service

These terms are the agreement between you and Riker Tech, LLC ("we", "us") for using Pump (listed as "Pump Fit" in the app stores): the Pump apps for iOS, watchOS and Android, the Pump App Clip, the website at www.pumpfitness.app, PumpIQ, and the services behind them (together, "Pump"). We have tried to keep them plain and short.
1. Accepting these terms
By creating an account or using Pump, you agree to these terms and to our Privacy Policy, which explains how we handle your data. If you do not agree, do not use Pump.
2. Who can use Pump
You must be at least 13 years old to use Pump. If you are under 18, or under the age of majority where you live, you may use Pump only with the permission of a parent or guardian who agrees to these terms for you. You may not use Pump if the law prohibits you from doing so, or if we have previously removed you from it.
3. Your account
- Give us accurate information and keep your email address current, since it is how we verify your account and send you sign-in codes.
- Keep your passkey, password, sign-in codes and devices secure. You are responsible for activity on your account.
- Tell us at help@pumpfitness.app if you think someone else has accessed your account.
- You can delete your account at any time from the app's settings. Deleting it removes your data as described in our Privacy Policy.
4. Health and fitness disclaimer
Pump is not medical advice. Pump, its tempo coach, workouts, exercise descriptions and videos, PumpIQ and any connected AI app provide general fitness information and tools only. They are not a substitute for advice from a doctor or other qualified professional, and they do not diagnose, treat or prevent any condition.
- Talk to a doctor before starting any exercise program, especially if you are pregnant, injured, or have a medical condition, and stop exercising if you feel pain, dizziness or shortness of breath.
- Exercise, including weight training, running and cycling, carries a real risk of injury. You choose what to do and how hard to push, use proper form and safe equipment, and train within your limits. You assume the risks of any physical activity you do while using Pump.
- Heart rate, calories, distance, pace, route, VO2 max and similar figures come from your devices and from estimates. They may be inaccurate and must not be relied on for medical purposes.
- When you record an outdoor activity, stay aware of your surroundings and obey traffic laws. Do not look at or operate the app when it is unsafe to do so.
5. Your content
"Your content" is what you create or upload in Pump: workouts, exercises, notes, photos, videos, comments, profile details, group material, PumpIQ messages and attachments, and anything else you add.
- You own your content. We do not claim ownership of it.
- You give us permission to run Pump with it. You grant Riker Tech, LLC a worldwide, non-exclusive, royalty-free license to host, store, copy, process, adapt (for example, resize a photo or convert a file), display and distribute your content, only as needed to operate, secure and improve Pump and to show your content to the people you share it with. This license ends when you delete the content or your account, except for copies other people have already saved (for example, a workout someone added to their own library from your share), content you shared into places others own (such as comments on someone else's workout or material in a group), and backups that cycle out over time.
- You are responsible for your content. Only upload content you have the right to share, and make sure it follows these terms and the law. If your content shows other people, you need their permission.
- Visibility is up to you. Your settings decide who can see your activity. Content you share by link can be viewed by anyone who has the link.
6. Acceptable use
Pump has a community of people training together. When you use it, including your profile, photos, videos, comments, groups and shared workouts, do not:
- Harass, threaten, bully, impersonate or discriminate against anyone
- Post sexual content, graphic violence, hate speech, or content that promotes self-harm or dangerous activities
- Post content that infringes someone else's copyright, trademark, privacy or other rights
- Share someone else's personal information without their permission
- Spam, advertise, or mislead people, including through fake accounts or fake activity
- Post anything illegal, or use Pump for any illegal purpose
- Upload malware, or try to break, overload, probe or get around the security or limits of Pump
- Access Pump through automated means other than the features we provide (such as connected AI apps), or scrape, copy or resell the service or other people's data
- Reverse engineer the apps, except where the law allows it despite this restriction
We may remove content, limit features, or suspend or close accounts that break these rules. You can block people and report problems to us at help@pumpfitness.app.
7. PumpIQ and connected AI apps
- PumpIQ is an AI coach that uses third-party AI models to write and change workouts and answer questions. Its output is generated automatically and can be wrong, incomplete or unsuitable for you. Review workouts and advice before you follow them, and use your own judgment. Section 4 applies to everything PumpIQ says.
- When you ask PumpIQ to create or change workouts or settings, it acts on your account at your direction. Check the result.
- Connected AI apps, such as ChatGPT, Claude or Meta's AI apps, are third-party services we do not control. When you connect one, you authorize it to read your Pump data and change your workouts as described on the approval screen and in our Privacy Policy. Its own terms and privacy policy govern how it uses your data, and we are not responsible for what it does or says. You can disconnect it at any time in Settings → Connected Apps.
- You may not use PumpIQ or a connection to Pump to break these terms or the AI provider's own rules.
8. Purchases
Pump is free to download. We may offer optional paid features or subscriptions. If we do, purchases in the app are processed by Apple through the App Store or by Google through Google Play, under their terms. Prices, billing periods and renewal terms are shown before you buy. Subscriptions renew automatically until you cancel, and you manage or cancel them in your App Store or Google Play account settings. Refunds are handled by Apple or Google under their policies. Deleting your Pump account does not cancel a subscription by itself.
9. Third-party services
Pump works with services from other companies, such as Apple (App Store, Apple Health, Apple Watch), Google (Google Play, Health Connect), SoundCloud, and the AI apps you connect. Your use of those services is governed by their terms, and we are not responsible for them. If you downloaded Pump from the Apple App Store, you also agree that Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them, that Apple has no obligation to provide maintenance or support for Pump, and that Riker Tech, LLC, not Apple, is responsible for Pump and for addressing any claims about it.
10. Our intellectual property
Pump, including its apps, software, design, tempo coach, built-in exercise library, demo videos, voice recordings and the Pump name and logo, belongs to Riker Tech, LLC and its licensors. We give you a personal, non-exclusive, non-transferable, revocable license to use Pump for your own training, under these terms. If you send us feedback or ideas, we may use them without any obligation to you.
11. Changes to Pump and ending your use
- Pump changes often. We may add, change or remove features, and may stop offering Pump, at any time.
- You can stop using Pump and delete your account at any time.
- We may suspend or close your account, or remove content, if you break these terms, if the law requires it, or to protect Pump, its users or others. Where reasonable, we will tell you why.
- Sections 4, 5 (for content already shared), 10, 12, 13, 14 and 15 continue after your account ends.
12. Disclaimers
Pump is provided "as is" and "as available". To the fullest extent the law allows, Riker Tech, LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that Pump will be uninterrupted, error-free or secure, that your data will never be lost, or that any workout, coaching or result will be suitable for you. Keep your own copies of anything important.
13. Limitation of liability
To the fullest extent the law allows, Riker Tech, LLC and its members, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any lost profits, lost data, personal injury arising from exercise, or loss of goodwill, arising from or related to your use of Pump, even if we were told they were possible. Our total liability for any claim relating to Pump is limited to the greater of the amount you paid us for Pump in the 12 months before the claim, or US $50.
Some places do not allow these limits, so some of them may not apply to you. Nothing in these terms limits liability that cannot be limited by law.
14. Indemnity
If someone brings a claim against us because of your content, your use of Pump, or your breach of these terms or the law, you agree to defend and compensate Riker Tech, LLC for the resulting losses and costs, including reasonable legal fees, to the extent the law allows.
15. Governing law and disputes
These terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-law rules. Any dispute relating to these terms or Pump will be brought in the state or federal courts located in the State of Washington, and you and we consent to their jurisdiction. If you live somewhere whose laws give you the right to bring claims in your local courts, or give you protections that cannot be waived by contract, those rights still apply. Before filing a claim, please email us at help@pumpfitness.app so we can try to resolve it informally.
16. Changes to these terms
We may update these terms from time to time. We will post the new version on this page with an updated date. If you keep using Pump after the change takes effect, you accept the updated terms. If you do not agree, stop using Pump and delete your account.
17. General
These terms and our Privacy Policy are the whole agreement between you and us about Pump. If any part of them is found unenforceable, the rest stays in effect. If we do not enforce a part right away, we have not waived it. You may not transfer these terms without our consent; we may transfer them as part of a merger, acquisition or sale of our business.
